Terms of Sale Overview
We reserve the right to end this listing at anytime should the vehicle no longer be available for sale. The following terms of sale apply to all of our auctions.
Out-of-state buyers are responsible for inventory tax and a documentary fee ($50). Inventory tax is calculated at 0.2107% of the sales price ($10.54 per $5000), $95 Admin fee, and a $95 make ready fee.
Texas residents are responsible for sales tax, inventory tax, registration/title transfer, documentary fee, $95 Admin fee, and a $95 make ready fee.
A 10% deposit is required after the auction has ended to secure the transaction.
Payment can be cash (in person), bank wire transfer, or cashier check.
All bidders must be able to pay cash or have all loans Pre-Approved before bidding. Remember ebay tm rules: When you bid you are entering into a legal and binding contract to purchase the vehicle.
Seller reserves the right to cancel this auction early.
Buyer pays shipping. Nxcess Motorcars ships upon receipt of payment. Nxcess Motorcars can assist in shipping arrangement, and limo services (additional charge) from the airport upon request.
The highest bidder will be contacted after the auction closes or he/she must respond within 48 hours to confirm his/her intention to buy. Buyer has 5 days to consummate the deal. Otherwise, Nxcess Motorcars has the right to contact other bidders or sell the car outside of this auction.
Disclosure of Used Car Risks and Advisory Warnings to Potential Buyers
At Nxcess, we want you to be delighted with the investment you make in any vehicle you purchase. We want you to become a repeat-customer who strongly recommends us to family, friends and neighbors. We know you will not be happy unless your expectations are met once you get the car from our showroom out onto the road.
We strive to maintain the highest reputation for honesty and integrity in dealings with our clients. Therefore, we want you to understand fully the risks of buying a used car from anyone, including us.
Especially when making a bid or purchase on E-Bay, do not rely merely on photographs of the vehicle or on telephone calls with our salespeople. You might receive the vehicle, disagree with the assessment your salesperson gave you, and feel that we misled you in some way.
To prevent that, we want you to come to our showroom, see the vehicle you are interested in, and take it for a complete and through mechanical inspection and test drive so that you are completely satisfied with its condition. If you do not want to come in person, we ask that you have someone you know and trust inspect the vehicle for you before you make a bid or purchase, as all sales are final and there are no refunds.
On E-Bay, once a "buy-it-now-bid" is transmitted or any bid wins an auction, a legally binding contract is formed. We sell all vehicles on an "As Is", "No Warranty" basis. That means Nxcess Motorcars provides no warranty or guarantee of the quality of any vehicle there is no other warranty provided. You need to verify with the original manufacturer whether they are still honoring the warranty. We do off for sale and can assist you in purchasing an extended after-market warranty under an addition contract for an additional charge.
We buy cars based on the appearance of the vehicle, its mileage, and its Car-Fax report. We do not independently inspect, test, or perform investigations into the vehicle's background. This means that the vehicle could have had a prior accident, mechanical problems, or body work that is not reflected on a Car-Fax report or its title.
Unless we owned the car itself throughout its life, and inspected every inch of the car before we sold it to you, we could not possibly describe or guarantee the condition of a used car let alone what the actual history of the car has been. Therefore, when you enter a transaction with us, it must be with the understanding that the burden of inspecting and satisfying yourself with the condition of your vehicle is on you, the buyer.
When purchasing a car from us, you also agree that any mediation or lawsuit arising out of any disputes surrounding the vehicle will be heard only and exclusively in Houston, Harris County, Texas, and that the law of Texas without reference to Texas choice of law rules shall govern. Prior to the filing of any lawsuit by either party to resolve any dispute which might arise, each party agrees to have a preliminary, half-day mediation before an independent, third-party mediator, and each party may, at the party's election, be represented by counsel. It is agreed that nothing stated at the mediation will be admissible as evidence in any trial.
We believe if we have these understanding and take these precautions before we do business, the likelihood is that we will not have any regrets down the road.
